Welcome to HallowWhim! The terms “we,” “us,” and “our” refer to HallowWhim. HallowWhim operates this store and website, including all related information, content, features, tools, products, and services, to provide you with a curated shopping experience (the “Services”). HallowWhim is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy, available at /policies/privacy-policy. If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.

To browse our store or purchase products, you may be asked to provide information such as your name, email address, telephone number, billing information, payment details, and shipping address.

You represent and warrant that all information you provide is accurate, current, and complete and that you have the necessary rights to provide it.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You may not transfer, sell, assign, or license your account to another person.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to accurately display and describe our products. However, colors, brightness, dimensions, proportions, and appearance may vary depending on your screen, device settings, lighting conditions, or the environment in which a product is used.

Projector brightness and image clarity may vary depending on ambient lighting, projection distance, wall color, surface texture, and power source. For the best results, our Halloween Projector should be used in a dimly lit or dark environment.

Minor variations that do not materially affect the product’s functionality may occur. Nothing in this section limits your rights if a product is materially different from its description, damaged, defective, or incorrect.

Product descriptions, availability, specifications, and prices may be updated without notice. We reserve the right to discontinue a product or limit quantities available to any person, household, geographic region, or jurisdiction.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase products from HallowWhim. We reserve the right to accept, reject, limit, or cancel an order for legitimate reasons, including suspected fraud, pricing errors, product unavailability, payment issues, or violations of these Terms.

An order is accepted after your payment has been successfully processed and we send an order confirmation.

Please review your order carefully before submitting it. We process orders quickly and may be unable to change or cancel an order after fulfillment has begun. If you need assistance, contact us as soon as possible at hallowwhim@gmail.com.

If we reject, modify, or cancel an order, we will attempt to contact you using the email address, billing address, shipping address, or telephone number provided at checkout. Any payment collected for a cancelled item will be refunded to the original payment method.

Purchases are subject to our Return & Refund Policy, available at /policies/refund-policy.

You represent that purchases are intended for personal or household use and not for unauthorized commercial resale or export.

SECTION 4 — PRICES, BILLING, AND PROMOTIONS

Prices, discounts, shipping offers, and promotions may change without notice. The price charged will be the price displayed at checkout when your order is submitted.

Prices may be displayed in your local currency based on your location, device settings, or Shopify Markets. Your payment provider may apply currency conversion charges or other fees outside HallowWhim’s control.

Unless expressly stated otherwise, displayed prices may not include taxes, duties, customs charges, import fees, or other government charges. Customers are responsible for applicable import charges unless the checkout expressly states that those charges are included.

You agree to provide accurate and complete billing, payment, and account information. You represent and warrant that:

1. The payment information you provide is accurate and complete.

2. You are authorized to use the selected payment method.

3. Charges incurred will be honored by your payment provider.

4. You will pay all amounts displayed and accepted at checkout.

Promotions may be subject to additional conditions. If promotional terms conflict with these Terms, the specific promotional terms will control.

For “Buy 2, Get 1 Free” or similar promotions, all qualifying and complimentary products are considered part of the promotional purchase. If a customer returns qualifying paid products but keeps the complimentary item, the regular value of the retained item may be deducted from the refund. To receive a full eligible refund, all products included in the promotion must be returned, unless HallowWhim determines that a return is unnecessary.

Free shipping promotions apply only under the conditions displayed at checkout and may exclude certain locations, expedited services, customs duties, taxes, or import charges.

SECTION 5 — SHIPPING AND DELIVERY

Processing and delivery estimates are provided for informational purposes and are not guaranteed unless expressly stated otherwise.

Delivery may be affected by carrier delays, customs processing, weather, incorrect addresses, high seasonal demand, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. HallowWhim is not responsible for delays or failed delivery caused by incorrect or incomplete information provided by the customer.

We remain responsible for handling verified cases involving products that are not delivered, arrive damaged, or are materially different from the order, subject to our policies and applicable law.

If an order is delayed beyond the timeframe communicated at purchase, we will provide any notice, cancellation option, or refund required by applicable law.

SECTION 6 — INTELLECTUAL PROPERTY

The Services—including trademarks, brand names, text, graphics, images, logos, videos, audio, product descriptions, reviews, website design, and the arrangement of content—are owned by HallowWhim, its affiliates, or licensors and are protected by Mexican and applicable international intellectual property laws.

These Terms permit you to use the Services for personal and non-commercial purposes only.

Without prior written authorization, you may not reproduce, distribute, modify, publish, publicly display, download, store, transmit, sell, or commercially exploit any part of the Services.

Nothing in these Terms grants you a license or ownership right over the intellectual property of HallowWhim, Shopify, or any third party.

HallowWhim’s name, logo, product names, designs, and slogans may not be used without prior written permission. Shopify’s name, logos, products, and service names are trademarks of Shopify. Other names, logos, and trademarks belong to their respective owners.

SECTION 7 — OPTIONAL TOOLS

We may provide access to tools or services operated by third parties. We do not necessarily monitor, control, or operate these tools.

Access to third-party tools is provided “as is” and “as available,” without warranties, representations, or endorsements, to the extent permitted by law.

Your use of third-party tools is at your discretion and may be governed by additional terms imposed by the applicable provider.

Future tools, resources, or features made available through the Services will also form part of the Services and remain subject to these Terms.

The Services may contain links or embedded functionality provided by third parties.

We are not responsible for examining or guaranteeing the content, accuracy, privacy, availability, products, or practices of third-party websites.

HallowWhim is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with HallowWhim. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and HallowWhim, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with HallowWhim.

SECTION 10 — PRIVACY POLICY

Personal information collected through the Services is handled according to our Privacy Policy, available at /policies/privacy-policy.

Certain information may also be processed under Shopify’s Privacy Policy. Because Shopify hosts the Services, Shopify processes information regarding your access to and use of the store to operate and improve the Services.

You represent and warrant that:

1. You own or have the necessary rights to submit the Feedback.

2. The Feedback reflects your genuine experience and is not false or misleading.

3. You have disclosed any compensation, free product, discount, or other incentive connected to your submission.

4. Your Feedback does not violate these Terms or the rights of another person.

We are not obligated to keep Feedback confidential, compensate you for Feedback, or respond to it.

We may monitor, edit, reject, or remove Feedback that is unlawful, abusive, deceptive, offensive, defamatory, obscene, fraudulent, or infringes intellectual property or privacy rights.

You may not impersonate another person, submit a false identity, or misrepresent the origin of Feedback.

We reserve the right to correct errors, update information, or cancel affected orders. If an order is cancelled after payment because of an error, the applicable amount will be refunded to the original payment method.

Nothing in this section permits HallowWhim to avoid honoring an order or advertised offer when applicable law requires otherwise.

You may access and use the Services only for lawful purposes. You may not use the Services:

No Agent may access, use, or interact with the Services unless it identifies itself and operates in accordance with Section 14.4. An Agent may not access the Services after we have requested that it stop.

We may use technical or other measures to limit whether and how an Agent accesses, uses, or interacts with the Services.

14.4

Agents must:

1. Identify requests as originating from an Agent and disclose the Agent’s name through the user-agent string using: “Agent/[agent name].”

2. Not conceal or misrepresent that an interaction originates from an Agent.

3. Not imitate human behavior to avoid detection.

4. Not complete or circumvent CAPTCHAs.

5. Respond truthfully when asked whether an interaction originates from a person or computer.

6. Not bypass any measure intended to control or restrict Agent access.

SECTION 15 — TERMINATION

We may suspend or terminate your access to the Services if you violate these Terms, engage in fraudulent or unlawful conduct, or create a risk to HallowWhim, Shopify, our service providers, or other users.

You remain responsible for amounts lawfully owed before termination.

Sections concerning Intellectual Property, Feedback, Warranty Disclaimers, Limitation of Liability, Indemnification, Severability, Governing Law, Privacy, and any provision that should reasonably survive will continue after termination.

SECTION 16 — DISCLAIMER OF WARRANTIES

Information provided through the Services is offered for general informational purposes. While we make reasonable efforts to maintain accurate information, we do not guarantee that every part of the Services will always be uninterrupted, secure, current, complete, or error-free.

Except for warranties expressly provided by HallowWhim, including our Return & Refund Policy, the Services are provided “as is” and “as available” to the maximum extent permitted by law.

To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement.

Nothing in this section excludes or restricts our 90-Day Return Policy, obligations relating to defective or incorrect products, or any warranty or consumer right that cannot legally be excluded.

SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, HallowWhim and its partners, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the Services or products purchased through the Services.

This may include lost profits, lost revenue, loss of data, replacement costs, or similar damages.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability resulting from fraud, intentional misconduct, gross negligence, personal injury where exclusion is prohibited, or mandatory consumer protection obligations.

Where liability cannot be completely excluded but may be limited, HallowWhim’s liability will be limited to the amount paid for the product or service giving rise to the claim, or the minimum amount required by applicable law, whichever is greater.

SECTION 18 — INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold harmless HallowWhim, Shopify, and our affiliates, partners, employees, agents, contractors, licensors, and service providers from third-party claims resulting from:

2. Your unlawful use of the Services.

3. Your infringement of another party’s rights.

4. Fraudulent or intentionally harmful conduct performed through your account.

We will provide reasonable notice of an indemnifiable claim. Failure to provide prompt notice will not relieve you of your obligations unless the delay materially prejudices your ability to respond.

The remaining provisions will continue in full force and effect.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may transfer or assign our rights and obligations in connection with a legitimate business transfer, restructuring, merger, acquisition, or transfer of the Services, subject to applicable law.

These Terms and any separate agreement through which HallowWhim provides Services will be governed by the applicable federal laws of the United Mexican States and, where applicable, the laws of the State of Mexico.

Subject to any mandatory consumer rights or dispute-resolution procedures, disputes will be submitted to the competent authorities or courts located in the State of Mexico, Mexico.

Nothing in this section prevents a consumer from exercising any non-waivable right or remedy available under the laws applicable to that consumer.

Headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

SECTION 24 — CHANGES TO THESE TERMS

You may review the current version of these Terms at any time on this page.

We reserve the right to update or replace portions of these Terms by publishing a revised version on our website.

When required by law, we will provide notice of material changes. Changes will become effective on the date indicated in the updated Terms and will not retroactively reduce rights already acquired through a completed purchase.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
